Processing of Personal Data

DISCLOSURE STATEMENT ON THE PROCESSING OF PERSONAL DATA OF CANDIDATES/EMPLOYEES AND CUSTOMERS BY HUMANRATE BİLGİ TEKNOLOJİLERİ AND ITS SOLUTION PARTNERS

a) Data Controller and Representative. Your personal data may be processed within the scope described below by Humanrate Bilgi Teknolojileri as the data controller, the Solution Partners of the Humanrate Platform and the users of the Humanrate Platform, in accordance with Law No. 6698 on the Protection of Personal Data (the “Law No. 6698”).

  • • In the evaluation process of candidates applying to our customers' open positions; tests, CV verification, competency assessment tests, expert opinions, and live or recorded audio and video recordings carried out so that the right candidates can be selected,
  • • Creating and managing customer records,
  • • Creating and managing the candidate pool, and accessing candidate information for open positions arising in subsequent periods,
  • • Carrying out fiscal, accounting and financial transactions, including sales-related invoicing activities, and performing risk management,
  • • Carrying out evaluation, analysis and risk management activities concerning customers within legal limits,
  • • Conducting customer relations and monitoring corporate governance activities,
  • • Managing and following up customer requests;
  • • Planning information security processes, and establishing and managing the information technology infrastructure,
  • • Reporting on our customer's employees, records of training provided to employees, expert opinions, foreign language tests, and personality inventory records,
  • • Planning and following up the work carried out with business partners and solution partners,
  • • Following up and executing legal processes and communication processes with official institutions,
  • • Conducting market research,
  • • Determining routes to optimize service itineraries,
  • • It will be processed within the scope of the personal data processing conditions and purposes set out in Articles 5 and 6 of Law No. 6698, for purposes such as controlling and analyzing data belonging to customers / candidates / employees in order to plan and follow up employees' performance evaluation processes and/or business activities.

 

In order for your personal data to be processed for certain specific purposes, we require that you have explicitly given your consent under Law No. 6698. If you have given your explicit consent on any platform, the purposes for which your data may be processed are listed below:

 

  • • Carrying out placement activities into suitable positions,
  • • Identifying the most suitable candidate by comparing job applicants and ensuring reliability,
  • • Ensuring information reliability and accurate decision-making in activities such as performance management and promotion of our customers' employees,
  • • For customers' new position requests, presenting proposals from the candidate records in the pool and, in this context, sending commercial electronic messages to candidates' contact details,
  • • Profiling employees by conducting tests and surveys to measure the products and services offered by the customer,
  • • Your personal data may be processed for purposes such as keeping, planning and executing event and organization records.

All of the purposes listed above are collectively referred to as the “Purposes”.

 

c) To Whom and For What Purpose Processed Personal Data May Be Transferred. In order to achieve the Purposes listed above, your collected personal data may be shared with — and transferred abroad to — Humanrate Bilgi Teknolojileri A.Ş. and its direct and indirect solution partners, our domestic and international business partners, our suppliers, our customers, event companies, digital agencies, call center service providers, audit firms, banks and other business partners, our affiliates, third parties from whom services are procured, and legally authorized public institutions and private persons and entities, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698.

 

d) Method and Legal Basis of Collecting Personal Data. Personal data is collected within the scope of the Purposes listed above by Humanrate Bilgi Teknolojileri's customers, candidates, solution partners and producers through different channels and on different legal grounds. The personal data collected in this process is obtained physically by us or through our business partners or authorized dealers and services; at promotional and sponsorship events, through our producers and other business partners; and digitally through channels such as websites, mobile applications and call centers. Your personal data is processed on legal grounds based on fulfilling the Purposes listed above and meeting our legal obligations.

 

e) Rights of the Personal Data Subject Listed in Article 11 of Law No. 6698. As personal data subjects, you have the right to: • learn whether your personal data is processed, • request information if your personal data has been processed, • learn the purpose of processing your personal data and whether it is used in accordance with that purpose, • know the third parties to whom personal data is transferred, domestically or abroad, • request the correction of your personal data if it has been processed incompletely or incorrectly, and request that this be notified to the third parties to whom the data has been transferred, • request the deletion or destruction of your personal data — within the framework of the conditions set out in Article 7 of Law No. 6698 — if the reasons requiring its processing cease to exist even though it has been processed in compliance with Law No. 6698 and other relevant legislation, and request that this be notified to the third parties to whom the data has been transferred, • object to the emergence of a result against you through the exclusive analysis of the processed data by automated systems, • request compensation for the damage in the event that you suffer damage due to the processing of your personal data in violation of the Law on the Protection of Personal Data. If you submit your requests regarding your rights through the methods set out under the “Protection of Personal Data” heading on our website www.humanrate.net, your request will be concluded as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request. This disclosure is made to the CANDIDATE within the scope of Article 10 of Law No. 6698 on the Protection of Personal Data (the “Law”). If you read and approve the information below, the interview and inventory results you provide here, together with the other personal data you submit for the purpose of being evaluated in the job application process, will be processed by the company to which you apply, in its capacity as data controller, and by HUMANRATE BİLGİ TEKNOLOJİLERİ A.Ş. in its capacity as data processor, and will be retained in accordance with the Law to be evaluated for potential career opportunities on our platform. Your processed personal data may be transferred — in a manner that is lawful, fair, connected with the purposes for which it is processed, and limited and proportionate — within the framework of Articles 8 and 9 of the Law, without distinction between domestic and abroad, to the domestic/international affiliates of the company to which you apply, to legally authorized judicial and administrative authorities, to our public institution partners, to our suppliers, and to legally authorized private-law persons such as independent audit firms. Your assessment relates to the legal process of processing your personal data, and your personal data here is collected via electronic communication methods through the HUMANRATE.net systems, subject to your consent. In relation to the processing of your personal data by our company, as a data subject and pursuant to Article 11 of the Law, you have the right to: learn whether your personal data is processed, request information if it has been processed, learn the purpose of processing and whether it is used accordingly, request correction of personal data transferred to third parties domestically or abroad if it has been processed incorrectly, request deletion or destruction of personal data if the reasons for processing cease to exist, request that correction or deletion operations be notified to the third parties to whom the data has been transferred, object to a result arising against you through the exclusive analysis of the processed data by automated systems, and request compensation if you suffer damage due to unlawful processing of personal data. In relation to my job application process, I consent to the processing of all the personal information I have entered here, the interviews and/or inventories, all the audio and video recordings I have made with the experts, and my related data, by the company to which I apply, in its capacity as data controller, and by HUMANRATE.net; to the transfer of my personal data — without distinction between domestic and abroad and without the need to obtain my consent again — to the affiliates, shareholders, legally authorized judicial and administrative authorities, public institutions and organizations, business partners, suppliers, and legally authorized private-law persons such as independent audit firms of the company to which I apply, in accordance with the legal regulations; and to the retention of my personal data for potential career opportunities, independently of the outcome of my job application; and I declare and accept that I have read all of the explanatory information provided to me regarding the processing of my personal data and that I understand all my rights.
